Summary of St. Jude Medical Limited Warranty

The following is a brief summary of certain terms and conditions of the St. Jude Medical limited warranty:

Summary of Products Warranted

St. Jude Medical implantable products are warranted to be free from defects in material or workmanship within one (1) year from the date of implantation or ownership when used in conformance with the instructions for its use and maintenance, subject to the other terms and conditions contained in this warranty. These products may include receiver, leads/lead kits, IPGs/IPG kits, extensions, and accessories.

St. Jude Medical patient accessories are warranted against defects in materials or workmanship for one year from time of sale. These products may include transmitters, patient programmers, battery chargers, and external batteries.

Summary of Warranty Claims

All warranty claims must be presented to St. Jude Medical and St. Jude Medical will, at its option:

1. Repair or replace the defective component with an equivalent, or functionally equivalent, at no charge to the patient-consumer; or
2. Issue a credit to the patient-consumer for a replacement St. Jude Medical implantable component or accessory, as applicable, the credit being equal to the net invoice price for the replaced implantable component or accessory.

Summary of Warranty Conditions

This limited warranty does not apply to:

1. Issue a credit to the patient-consumer for a replacement St. Jude Medical implantable component or accessory, as applicable, the credit being equal to the net invoice price for the replaced implantable component or accessory.Any damage caused by misuse, neglect, accident, modification, improper application, or from other than normal and ordinary use;
2. Any damage caused by any repair or attempted repair by one other than an authorized St. Jude Medical-trained technician;
3. Any damage resulting from failure to clean or use in accordance with the St. Jude Medical instruction manuals supplied with the product;
4. Products that have not been registered by completing a warranty registration card and returning to St. Jude Medical within 60 days of implant or purchase.

St. Jude Medical disclaims liability for, and shall not be responsible for, any medical expenses or any direct, incidental or consequential damage arising out of, or in connection with, the use or performance of the system, whether such claim is based on contract, tort, warranty or otherwise.
